TERMS OF USE

1. GENERAL INFORMATION. OWNERSHIP OF THE WEBSITE.

Through this legal notice and information, COMUNICANT, S.L., hereinafter KMK, with NRT: L-709063-L, regulates the use of the internet portal service https://finpp.com made available to internet users. For any communication with the company, users may contact hola@grupbusco.com.

2. ACCEPTANCE OF THE TERMS OF USE.

Access to the portal and/or its use in any form grants the status of Portal user and implies full and unconditional acceptance of these general terms of use. The user must read this legal notice whenever they intend to use the portal, as it may be modified. The use of certain services may also imply acceptance of specific rules or instructions established by KMK.

Within the limits established by law, the WEBSITE assumes no liability for lack of truthfulness, completeness, updating or accuracy of the data or information contained on its website. The website may contain links to third-party pages that KMK cannot control and for whose content KMK assumes no responsibility.

3. PURPOSE, SERVICES AND ACTIVITIES.

KMK offers website design and development, mobile applications and search engine positioning services. It also buys and sells, wholesale and retail, domains, space, bandwidth and authenticity certificates.

KMK may expand or modify the portal with new services, activities or content, and reserves the right to cancel, modify or restrict content, services or activities, expressly and with prior notice to users.

4. ACCESS CONDITIONS.

4.1 Legal age of the user.

Access to https://finpp.com is restricted exclusively to persons over 18 years of age. KMK may immediately and without prior notice terminate users who do not meet, or appear not to meet, this requirement. KMK may request proof of age and an identifying photograph from any advertiser.

4.2 Status, capacity and concept of user.

A user is any natural or legal person of legal age who accesses the portal to view, browse, search, consult content or publish an advertisement. Access for mere consultation does not require prior registration. For certain services, such as inserting advertisements, formal registration or completion of the electronic form will be required.

The user must freely, expressly and voluntarily provide and authorise the processing of personal data and its transfer to persons interested in the advertisements. Before submitting personal data, the user must accept the privacy policy and declares that they have all necessary authorisations and consents. The user is responsible for everything they publish and for any damage caused. In the event of misuse, KMK may provide advertiser information to police, courts or competent authorities. KMK assumes responsibility in accordance with personal data protection regulations.

4.3 Free service.

Consultation of the portal is generally free. Publication of advertisements may be subject to payment according to the fees and payment conditions published on the portal.

4.4 Use of the portal.

The user accepts that use of the content and services is at their sole risk and responsibility, and undertakes to use the portal in accordance with applicable law, these conditions, publication rules, good faith, good customs and public order.

The user undertakes not to use the portal for unlawful or criminal activities or to infringe third-party rights, intellectual or industrial property rights or any applicable regulations.

  • Not to publish or disseminate content that infringes fundamental rights, promotes criminal, degrading, defamatory, violent or discriminatory conduct, or is contrary to law or public order.
  • Not to publish false, ambiguous, exaggerated or inaccurate content.
  • Not to publish content protected by third-party intellectual or industrial property rights without authorisation.
  • Not to infringe honour, privacy, image rights or confidentiality of communications.
  • Not to publish unlawful, misleading or unfair advertising.
  • Not to introduce viruses, Trojan horses, applets, ActiveX controls, worms, time bombs or other harmful material, nor unauthorised hyperlinks.
  • Not to damage KMK’s reputation, incite unlawful conduct, disseminate racist, xenophobic, terrorist-apology or human-rights-infringing content, mislead users, impersonate others, use fictitious phones or emails, use robots, spiders, scrapers or automated means without written consent, abuse the report system, send unauthorised communications, disrespect third parties, collect third-party personal data without consent, or bypass access restrictions.

5. Truthfulness of information.

The information provided by the user must always be truthful. The user is responsible for any false, vague or inaccurate statements, data, content or details. Personal data provided for customer registration or publication of an offer must be true, accurate and consistent.

The user undertakes to communicate any future changes to their personal data. Inaccuracy exempts KMK from liability where KMK has acted with due diligence. The user is solely responsible for false or inaccurate statements and for damage caused to COMUNICANT, S.L. or third parties.

The use of nicknames or pseudonyms shall not be considered lack of truthfulness provided that it does not prevent identification or collection of the amounts due. If KMK becomes aware of or suspects false data or images, it may immediately deactivate the advertisement without prior notice.

6. Procedure in the event of improper activities, incorrect or fraudulent data.

If any user or third party considers that content or activity on the WEBSITE is improper, including inappropriate images, infringement of intellectual property rights or breach of these conditions, they must notify the service provider with:

  • Personal details of the complainant: name, address, telephone and email.
  • Specific description of the alleged unlawful activity and, where rights are allegedly infringed, precise identification and location of the protected content.
  • Facts or circumstances showing the unlawful nature of the activity.
  • In case of rights infringement, handwritten or equivalent signature and details of the rights holder or authorised representative.
  • An express and clear declaration, under the complainant’s responsibility, that the information provided is accurate and that the reported use or activity is improper.
  • KMK shall immediately adopt measures to correct or remove the content.

7. Liability for operation and content of the portal.

KMK is not liable for portal failures, interruptions, delays, slowness, losses or disconnections in communications or message transmission, and does not guarantee continuous and uninterrupted operation.

Although KMK seeks to apply high technological standards, it is not liable for damages caused by viruses or other elements in the portal’s content or services, access errors, connection or transmission failures, unjustified interruptions, intrusions, mass advertising by third parties, problems external to the portal, user equipment defects, connection deficiencies, internal viruses, operator problems or force majeure.

KMK does not guarantee the quality, accuracy or reliability of data, images, information or opinions circulating on the portal. The user assumes responsibility for the consequences of accessing such content. KMK may refuse to publish advertisements that do not meet minimum quality requirements.

The website may contain links to pages independent from KMK. KMK is not responsible for their content, quality, reliability, accuracy, modifications, use or technical availability. If a third party considers that a link from KMK harms their rights, they may notify hola@grupbusco.com so that it can be removed or modified.

KMK is not responsible for acts of third parties outside the system, including viruses, mass advertising, commercial emails, interruptions or unauthorised access. It is not responsible for statements in forums, chats or discussions, although it will seek proper use and may remove inappropriate interventions.

KMK declares that it has adopted technical, legal and organisational measures for secure communications and personal data protection, but does not guarantee total invulnerability or inviolability. KMK is not liable for force majeure or circumstances not attributable to it.

8. Industrial and intellectual property of the website.

KMK owns, or has the relevant licences for, the intellectual and industrial property rights over the domain name, trademarks, distinctive signs, application, information, works, inventions, technology and content of the website.

The website content, including designs, applications, text, images and source code, is protected by intellectual and industrial property rights and may not be used, reproduced, copied or transmitted without prior written and explicit permission from KMK.

The user shall not delete, modify, plagiarise or alter any distinctive sign, trademark, trade name, legend, graphic or logo. Access to the portal does not grant any ownership, exploitation, modification, appropriation, commercialisation or unfair competition rights.

KMK is a registered trademark whose exploitation rights belong exclusively to COMUNICANT, S.L.

The user accepts that images and texts sent to KMK may be made available to other users without limitation. The user declares that they own or hold all necessary rights over the submitted files and authorises KMK to edit, reproduce, distribute, publicly communicate, use and exploit them without geographical or time limitation, in accordance with the portal’s purposes.

The user undertakes to use information only for their own consultation or assistance needs and not to commercially exploit services, content or photographs. The user authorises KMK to transfer images, texts and other works to similar media or websites to increase dissemination of advertisements or listings.

The user shall refrain from acts contrary to morality, public order, good customs, dignity, honour, image, privacy or legality. Responsibility for prohibited or unlawful actions rests exclusively with the user, who shall hold KMK harmless.

9. Modification of the website and suspension of the service

KMK reserves the right to make any modifications it deems appropriate to the portal, organising, deleting or adding content, data or services unilaterally and without prior notice. KMK may modify these conditions or add new clauses to adapt to new activities, services or legislation; such changes apply from their entry into force.

KMK may suspend the service or deny access to the portal, temporarily or indefinitely and without prior notice, to any user who breaches these conditions or carries out illegal acts contrary to law, public order or good customs.

10. Duration, termination, resolution.

Although the portal services are, in principle, indefinite, KMK may temporarily suspend or definitively terminate the service at any time for justified cause. KMK may modify the terms of use at any time, and the user will be bound by the conditions published when accessing or using the portal.

In case of unilateral termination or forced cancellation, KMK shall inform the user of the reasons and keep the information stored on its server for 10 calendar days, after which it shall block it in accordance with personal data protection regulations.

11. Applicable law and jurisdiction.

These General Terms of Use are governed by the laws of Andorra and submitted to the jurisdiction of the competent Courts and Tribunals of Andorra. Any dispute relating to the portal shall be heard by Andorran jurisdiction, with express waiver of any other jurisdiction.

12. Notifications

KMK may communicate with the customer by postal mail, email, telephone calls or any other public means, provided that such information has been duly communicated to KMK. The user declares that the data provided are true, accurate and correct and undertakes to notify any changes.

13. Exclusion of warranties and liability.

KMK does not guarantee the availability, access or continuity of the portal and services, and is not liable, within legal limits, for damages caused by unavailability, access failures or lack of continuity.

KMK does not previously review, control, approve or adopt third-party content, products, services, opinions, communications, data or files, and does not guarantee their legality, reliability, usefulness, truthfulness, accuracy, completeness or currency, nor the lawful use made by users.

KMK cannot guarantee the authorship or integrity of photographs, images or content provided by users and is not responsible for possible infringement of third-party rights. It is not liable for negligent or malicious use of mobile numbers or email accounts used to insert, modify, delete or respond to advertisements, nor for later use of contact data by advertisers.

KMK is not responsible for content uploaded or acts committed by other users, viruses or elements in third-party content or services, economic or reputational losses or special damages arising from use of the website, unless it had effective knowledge of unlawfulness and failed to act diligently to remove or block access.

14. COOKIES.

KMK will use cookies to speed up the service and identify each user as quickly as possible. Cookies are small files used to remember visited pages and facilitate future browsing.

The user may delete or block cookies using the browser’s default options. In some cases, disabling cookies may prevent proper website operation. Cookies are used to facilitate browsing in the information society service provided by the WEBSITE and not for additional purposes. If the user continues browsing, KMK understands that their use is accepted.

15. PROFESSIONAL RATE SERVICE.

15.1 Limits with quota request.

  • Although a rate may be “unlimited”, users must request periodic quotas to continue adding vehicles.
  • This system allows each request to be reviewed for compliance with established rules.
  • The aim is to guarantee quality and transparency in vehicle publication.

15.2 Import limits.

  • Automatic import of vehicles from unauthorised external sources will be blocked.
  • Vehicles may only be added through prior verification.

15.3 Rate modification.

  • Any rate change, up or down, must be requested with at least 15 days’ notice and will apply at the beginning of the next billing period.

15.4 Filter to prevent policy infringements.

  • An automatic and manual moderation system may be implemented to detect and reject vehicles that breach rules.
  • Users may report suspicious advertisements, helping ensure a safer and more reliable space.

16. REPORTING ADVERTISEMENTS.

16.1 Truthfulness of information provided

  • The user who uses the advertisement reporting form undertakes to provide truthful, accurate and complete information. KMK may reject or ignore reports with false, vague or unfounded data. Fraudulent use of the reporting system may lead to technical or legal measures.

16.2 Data processing

  • Data provided through the reporting form will be processed by KMK solely to manage and assess the report. Such data may be communicated to administrative authorities or competent public bodies in consumer matters, especially the Andorran Consumer Agency, if required by the nature of the report.

16.3 Legal basis and transfer

  • The legal basis for processing and, where applicable, transferring data is KMK’s legitimate interest in ensuring legality of published content, protecting consumer and user rights and complying with applicable legal obligations.

16.4 Confidentiality

  • The reporting party’s personal data will be treated confidentially and will not be communicated to affected parties unless legally or judicially required.

16.5 Acceptance

  • By using the reporting form, the user declares that they have read and accepted this section. KMK is not responsible for misuse of the reporting system or consequences arising from incorrect information provided by the user.

17. Breach of conditions and no-refund policy

If the user totally or partially breaches these Terms of Use, publication rules, current legislation or makes fraudulent, improper or bad-faith use of the portal, KMK may immediately suspend, block or cancel access to contracted services and remove published advertisements without prior notice.

These measures may be adopted without the user being entitled to any total or partial refund, since payment remunerates access to the service and publication possibility, and does not guarantee permanence of content in case of breach.

KMK assumes no responsibility for economic, commercial or other losses suffered by the user as a result of suspension or cancellation caused by a breach attributable to the user.

La present clàusula te per objecte regular l’intercanvi de dades personals d’usuaris interessats en productes financers que es puguin recollir pels simuladors de préstec o hipoteca integrats als portals buscocotxe.ad, buscomoto.ad i buscocasa.ad (d’ara endavant, "Portals") i ser transmesos a CRÈDIT ANDORRÀ, SA (en endavant, “CREAND"), per a la gestió comercial, l’anàlisi o la formalització de productes.

D'ara endavant, CREAND i COMUNICANT, S.L, es denominaran conjuntament i de manera indistinta, com les "Parts" o, individualment, de manera indistinta i quan escaigui, com la "Part".

Ambdues Parts resten sotmeses al compliment de la Llei 29/2021, de protecció de dades personals del Principat d’Andorra (LQPD), i la normativa que la desenvolupa.

Les parts reconeixen expressament que cadascuna actua com a responsable independent del tractament de les dades que recull o rep, determinant de manera autònoma les finalitats i els mitjans d'aquest tractament:

CREAND tractarà les dades rebudes dels Portals amb la finalitat de contactar amb els interessats, oferir productes financers i gestionar possibles relacions pre contractuals o contractuals tractarà les dades personals

Cada Part serà responsable de garantir que compta amb una base legal vàlida per al tractament de les dades:

- Els Portals hauran d'obtenir el consentiment informat de l'usuari per comunicar les dades a CREAND, entès suficientment atorgat amb l’acceptació dels Termes i Condicions posats a disposició dels usuaris a tal fi.

- CREAND basarà el tractament en aquest consentiment o en l'execució de mesures pre contractuals sol·licitades per l'interessat.

Igualment, haurà d'informar els usuaris, en les seves respectives polítiques de privadesa, sobre:

- La condició de responsable del tractament.
- Les finalitats i les bases jurídiques aplicables.
- Els drets que els assisteixen (accés, rectificació, supressió, oposició, limitació i portabilitat).
- La possible comunicació de les dades a l'altra part.

Ambdues Parts es comprometen a aplicar mesures tècniques i organitzatives adequades per garantir la seguretat, integritat i confidencialitat de les dades personals tractades, de conformitat amb l’article 36 de la LQPD

Cada part conservarà les dades personals durant el temps necessari per al compliment de les seves pròpies finalitats, respectant els terminis legals aplicables, i procedirà a suprimir-les un cop assolides o un cop finalitzats els referits terminis.

Cada part respon individualment dels danys o incompliments derivats del seu propi tractament de dades, sense que es pugui interpretar responsabilitat solidària llevat que s'acrediti una corresponsabilitat efectiva en la determinació conjunta dels mitjans i fins del tractament.
